Terms and Conditions for Eblem

Acceptance of Terms

By accessing and using Eblem ("Service"), you accept and agree to be bound by the terms and provision of this agreement.

Changes to Terms

We reserve the right, at our sole discretion, to amend these Terms of Service at any time and will update these Terms of Service in the event of any such amendments.

Account and Access

To access and use our Service, you may need to register with us and set up an account with your Google account or your email address. You are solely responsible for keeping access to that account secure and for all activities associated with or occurring under your account.

Your Responsibilities

You are responsible for all content you upload, post, email or otherwise transmit via the Service. You agree to comply with all laws and regulations applicable to your use of the Service.

Payment and Fees

Creating and refining logos is free within a daily allowance. Unlocking a logo is a one-off payment at the price shown at checkout, taken by Stripe. Prices are in US dollars and may change; the price you pay is the one shown when you pay. Questions about a charge go to [email protected].

Your Logo

When you unlock a logo, the logo and every file in its kit are yours. You may use, reproduce, modify and display them for any commercial or personal purpose, anywhere, for as long as you like, with no attribution to us. Gradient Insight Ltd claims no ownership of your brand name or of the logo you unlocked, and will not sell that logo to anyone else. Logos you have not unlocked may be used for preview and evaluation only. Registering the logo as a trade mark is your responsibility; we do not check it against existing marks.

Refunds

If an unlocked logo is not what you wanted, email [email protected] within 30 days of the purchase with the order reference from your receipt and we will refund it in full.

Intellectual Property

Apart from logos you have unlocked, the Service and its original content, features and functionality are and will remain the exclusive property of Gradient Insight Ltd. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Limitation Of Liability

In no event shall Gradient Insight Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.
